Proposed Changes to the Environmental Regulation (Scotland) Guidance on Public Participation and Fit and Proper Person Test

I wanted to let you know about the latest SEPA consultation on proposals that will change how we authorise and regulate waste management, water and industrial activities. The consultation on proposed changes to the Environmental Regulation (Scotland) guidance on public participation and Fit and Proper Person test, is the next step in implementing the Integrated Authorisation Framework (IAF) and a simpler, integrated system for environmental regulation across Scotland.

Proposed changes

Following Scottish Government proposals to amend the Environmental Authorisations (Scotland) Regulations 2018 (EASR), we're proposing changes to our own guidance relating to:

·         Public participation - adding a requirement to our Public Participation Statement that for some authorisations, prospective applicants will need to engage in public consultation at the pre-application stage.

·         Who can hold an authorisation – updating our approach to how we determine if an applicant is a fit and proper person and can hold a registration or permit (the ‘Fit and Proper Person’ test). You can read our consultation and share your views on our consultation hub.
